The McCain - Youtube spat takes another step.  In summary: The DMCA requires service providers to act on any takedown notices, not to spend time evaluating each one's merits.  So when someone makes a well-formed takedown request, Youtube will take a video down.  The rightness or fair-useness of that is outside the scope of the takedown decision and can be tussled over later by greased lawyers with Bat'leths.

Of course this was highlighted as a weakness in the DMCA's "Safe Harbor" provisions ages ago, but was bulldozed over by the Republican machine.  Including McCain.
